Implement Centre’s RERA rules, demand Gurgaon Home buyers

Gurgaon home buyers believe the RERA draft rules of the Haryana government seeks exemption for projects for which the builders have already obtained completion or occupation certificates City home buyers on Sunday said no to the real estate regulatory authority (RERA) draft of the Haryana government and demanded implementation of the Act enunciated by the Centre.

Home buyers met at Leisure Valley in Sector 29 on Sunday and unanimously agreed to send a message to the Haryana government to implement RERA rules of the Centre that have won plaudits across states.Home buyers said dilution of the Centre’s RERA draft is not acceptable. They termed the rules drafted by the state government as pro-builder.

The buyers said that the RERA draft dilutes the definition of ongoing projects by the central government and provides an escape route to builders who have not completed even a single project in past 40 years in Gurgaon. The builders include DLF, Ansal, Unitech, Vatika etc, said buyers.

A buyer said that the RERA draft rules of the Haryana government clearly seeks exemption for projects for which the builders have obtained completion or occupation certificates (CC/OC).“If the government does not act on our suggestions, we would take the legal course,” said Gaurav Prakash, a member of Federation of Apartment Owners’ Association (FAOA), Gurgaon.

CC means certification by the competent authority that the real estate project has been developed according to the sanctioned plan, layout and specifications as approved by the authority.“OC, on the other hand, is a certificate issued by the competent authority, as per rules, permitting buyers to move into their apartments,” Shephalika Sharma, another member of FAOA who was present at the meeting, said.

Homebuyers decided that they will prepare a final draft and send it to the Haryana government on Monday.RS Rathee, president of Gurgaon Citizens’ Council who was present at the meeting, said, “Except Garden Estate in Gurgaon, not a single project, with an occupancy of roughly 200, has obtained completion certificate. They should all be brought under RERA. The Haryana government draft dilutes this part. The government must disclose the bank guarantee deposit of each and every builder and their deficiencies on its website with a proper definition of ongoing projects.”

Praveen Jain, president of national real estate development council (Naredco), had said during a press conference in Gurgaon on Friday, “We will seek buyers cooperation for our smooth functioning. RERA draft is balanced and there should be no panic.”
